Right of Withdrawal

Scope

This withdrawal notice applies to consumers within the meaning of § 13 German Civil Code (BGB) who enter into a paid contract for digital services with Achtung.app – in particular the Custom Niche Report available at /research. For use in the course of a commercial or professional activity (B2B) no statutory right of withdrawal exists.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of contract conclusion.

To exercise your right of withdrawal, you must inform us (Martin Kulawik, Chodowieckistr. 40, 10405 Berlin, email: hello@achtung.app) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and not later than fourteen days from the day on which we receive notice of your withdrawal. For this reimbursement we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees as a result of this reimbursement.

If you requested that the provision of services should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of services already performed up to the point at which you inform us of the exercise of the right of withdrawal, compared with the full coverage of the contract.

Early Expiry of the Right of Withdrawal

Your right of withdrawal in respect of a contract for the supply of services expires prematurely if we have fully performed the service and we started the performance only after you gave your express consent and at the same time confirmed your acknowledgment that you lose your right of withdrawal upon our full performance of the contract (§ 356(4) BGB). For a contract for the supply of digital content not on a tangible medium, the right of withdrawal also expires once we have started the performance of the contract after you expressly consented to us starting performance before the withdrawal period had expired, you confirmed your acknowledgment that by giving such consent you lose your right of withdrawal once performance begins, and we have provided you with a confirmation of the contract on a durable medium (§ 356(5) BGB).

During checkout for the Custom Niche Report you expressly request that Achtung.app begin producing the report immediately upon receipt of payment. At the same time you confirm your acknowledgment that you lose your right of withdrawal once the service has been fully performed – namely upon delivery of the finished PDF report.
