Terms of Service

Scope

These Terms govern your access to and use of Achtung.app. By using the service, you agree to these Terms and to our Privacy Policy.

Services

Achtung.app provides GEO monitoring features, including AI visibility scoring, citation and competitor tracking, alerts, dashboards, reports, and optional free scan workflows. Features may change as the product evolves.

Service Communications

By requesting a free scan or using the service, you agree to receive operational emails required to deliver the service, including scan confirmation links, result links, and service-related follow-ups. These messages are necessary for product operation and are not optional marketing newsletters.

Accounts and Access

You are responsible for account credentials, account activity, and the accuracy of data submitted by you or your users. You must ensure that use of client or third-party data is authorized.

Acceptable Use

You may not use the service for unlawful activity, abuse of third-party systems, automated misuse, security testing without permission, or attempts to reverse engineer or disrupt the platform.

Reports and Outputs

Scores, classifications, recommendations, and reports are informational outputs based on available model and query data. They are not guarantees of ranking, visibility, traffic, or commercial outcomes.

AI Data Processing

To deliver visibility analysis, Achtung.app transmits brand names, keywords, and domain information to third-party AI providers (including OpenAI, Google Gemini, Perplexity, Anthropic, xAI, and Mistral). No personal account data is shared with these providers. AI provider responses may vary and are outside our control. We are not responsible for the accuracy, availability, or behaviour of third-party AI services. Details on data handling are set out in our Privacy Policy.

Third-Party Integrations

If you connect third-party services (for example Google Search Console), you authorize us to process related data needed to provide the feature. Your use of third-party services remains subject to their terms.

Intellectual Property

All platform code, design, branding, and documentation remain our property. Reports and scores generated for your account may be used by you for your internal business purposes. You grant us a limited, non-exclusive licence to process data you submit (brand names, keywords, domains) to provide the service and to generate aggregated, anonymised insights as described in the "Aggregated and Anonymised Data" section below. You may not redistribute, resell, or publicly republish raw platform outputs (scores, reports, data exports) as a competing service.

Aggregated and Anonymised Data

In addition to providing the service, we may use data submitted to the platform – including data from paying subscribers and from free public scans – in aggregated, anonymised, and statistically combined form for product analytics, industry benchmarks, public insights (such as those displayed on our /insights page), service improvement, and research. Aggregated outputs are produced using k-anonymity thresholds: no category, niche, provider, or competitor is published unless a minimum number of independent contributors is present, so individual brands, customers, or persons cannot be re-identified. We never publish raw inputs, brand names, account-level scores, or any data attributable to your account. Once anonymised, aggregated statistics fall outside the scope of personal data under GDPR Recital 26. The legal basis for the underlying processing is GDPR Art. 6(1)(f) (legitimate interest in industry research and service improvement). You may object to the use of data attributable to your account for these purposes at any time by contacting us – see the Privacy Policy for details.

Free Scan

The free scan is a limited, no-charge analysis. Each domain is scanned only once: if a scan for the requested domain already exists, additional users with a verified email at that domain are shown the existing results instead of triggering a new scan. Free scan data is retained for up to 90 days. We may modify, limit, or discontinue the free scan at any time without notice. No service-level commitments apply to the free scan.

Subscriptions

Paid plans are offered as monthly subscriptions, processed by Stripe Technology Company Limited (One Wilton Park, Wilton Place, Dublin 2, D02 FX04, Ireland) as our payment provider. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period – you retain access until then. No pro-rata refunds are issued for partial billing periods. We reserve the right to adjust pricing with at least 30 days advance notice; continued use after the new pricing takes effect constitutes acceptance.

Consumer Right of Withdrawal

Consumers within the meaning of § 13 German Civil Code (BGB) have a statutory right of withdrawal when entering into paid distance contracts (in particular the Custom Niche Report). The details, deadlines, consequences, and the model withdrawal form are set out in our Withdrawal Policy at /en/withdrawal. For digital services with immediate performance, the right of withdrawal expires upon full performance of the contract once you have expressly consented at checkout to immediate commencement and acknowledged that you lose your right of withdrawal upon full performance (§ 356(5) BGB).

Fees and Billing

All prices are stated in euros and exclude applicable VAT. VAT is added where required by law based on your location. Invoices are issued automatically by Stripe.

Warranty and Availability

We endeavour to provide the service reliably but do not guarantee uninterrupted or error-free availability. Planned maintenance is announced in advance where feasible. We are not liable for outages caused by third-party AI providers, hosting infrastructure, or force majeure events (natural disasters, government actions, widespread internet failures). For paid subscribers, our target availability is 99% monthly uptime measured at the application level, excluding planned maintenance. This is a best-effort target, not a contractual guarantee.

Suspension

We may suspend or restrict access when reasonably necessary for security, legal compliance, unpaid fees, or material breach of these Terms.

Liability

Our liability for damages caused by slight negligence is limited to foreseeable, typically occurring damages, and only where we have breached a material contractual obligation (Kardinalpflicht). This limitation does not apply to damages arising from injury to life, body, or health, or from intentional misconduct or gross negligence. Our total aggregate liability for all claims arising under these Terms is limited to the fees paid by you in the twelve months preceding the claim. To the extent permitted by law, we exclude liability for indirect, incidental, or consequential damages.

Term and Termination

You may stop using the service at any time. We may terminate access for material breaches, repeated abuse, or legal reasons. Data handling after termination follows our Privacy Policy and applicable law.

Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes is Berlin, Germany, to the extent permitted by law.

Changes to These Terms

We may update these Terms to reflect legal, operational, or product changes. Material changes will be communicated at least 30 days in advance via email or in-app notification. Continued use after updates become effective constitutes acceptance of the revised Terms.
